Following the conclusion of any trial period, continued access to our software as a service platform requires the purchase of a subscription. You may choose from our available subscription plans to continue using these services.

You agree not to input any illegal, harmful, misleading, or infringing content or deal details on the Website.

To utilize certain features of the Website, you may be required to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account

If you are registering as a broker, agent, or representative acting on behalf of a Principal, you must clearly indicate this and provide any necessary information about your brokerage and the Principal, as required by Plumdeals.net.
  2. Software as a Service (SaaS) Subscription Terms
    1. Subscription Options and Features: We offer various subscription plans for our software as a service platform, each providing access to a specific set of features and functionalities as detailed on our pricing page or other areas of the Website. These plans may include monthly and annual billing options. We reserve the right to modify the features and functionalities included in each subscription plan at any time.
    2. Subscription Fees: The fees for each subscription plan are clearly displayed on our pricing page or will be communicated to you before you select a plan. All fees are stated in United States Dollars (USD) unless otherwise specified and are exclusive of any applicable taxes. We reserve the right to change our subscription fees at any time, but we will provide you with reasonable advance notice of any such changes.
    3. Billing and Payment:

Payment Authorization: By selecting a subscription plan and providing your payment information, you authorize us (or our third-party payment processor) to charge your designated payment method (e.g., credit card, debit card) for the applicable subscription fees and any applicable taxes on a recurring basis, corresponding to your chosen billing cycle (monthly or annually).

      3. Recurring Billing: For monthly subscriptions, you will be billed on the same day of each month (or the closest date if the month has fewer days) following your initial purchase. For annual subscriptions, you will be billed on the anniversary of your initial purchase date each year.
      4.  Failed Payments: If your payment method fails or your account is past due, we may attempt to charge the payment method again. If the payment continues to fail, we may suspend or terminate your access to the SaaS platform without notice until the outstanding balance is paid. We may also charge interest on overdue amounts as permitted by law, the specific rate of which will be disclosed upon application of such charges.
      5. Receipts: Upon successful payment, you will receive a receipt or confirmation email at the email address associated with your account.
      6. Automatic Renewal: Your subscription will automatically renew at the end of each billing period for the same duration as your initial subscription (e.g., monthly subscription renews monthly, annual subscription renews annually) unless you actively cancel your subscription before the renewal date. The renewal fee will be based on the then-current subscription rate for your chosen plan. You can manage your subscription and disable automatic renewal at any time through your account settings on the Website. It is your responsibility to ensure that you cancel your subscription if you do not wish for it to renew.
    4. Cancellation:
      1. Cancellation by You: You may cancel your subscription at any time through your account settings on the Website. The cancellation will be effective at the end of your current billing period. For example, if you cancel a monthly subscription in the middle of the month, you will still have access to the SaaS platform until the end of that month, but you will not be charged for the following month. Similarly, for annual subscriptions, access will continue until the end of the current year.

Cancellation by Us: We reserve the right to suspend or terminate your subscription at any time for any reason, including but not limited to violation of these Terms (such as posting illegal content, engaging in spamming, harassment of other users, or providing false information), non-payment of subscription fees, or if we discontinue offering the SaaS platform. In the event of termination by us for reasons other than your violation of these Terms, we may, at our discretion, provide a pro-rata refund for any unused portion of your prepaid subscription fees.

If you do not agree to the changes, you have the right to cancel your subscription before the next billing cycle. The Principal shall be ultimately responsible for the obligations and liabilities arising from any transactions conducted by their broker or agent on their behalf.
    5. Account Management by Brokers: If Plumdeals.net provides the functionality for brokers to manage multiple accounts, brokers are responsible for ensuring that each account complies with these Terms and for maintaining the security and confidentiality of login credentials for all accounts under their management.
  2. Notifications (SMS and Email)
    1. By creating an account and using our services, you expressly consent to receive notifications from us via email and SMS (text messages) regarding deals that match your stored criteria, as well as important updates and announcements related to the Website and your account. You can manage your notification preferences through your account settings on the Website; however, certain essential service-related notifications may be required and cannot be disabled. You are responsible for any messaging or data fees that may be charged by your mobile carrier.
  3. Indemnification
    1. You agree to indemnify, defend, and hold harmless Western Star Group, LLC, its officers, directors, employees, agents, licensors, and suppliers from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to: (a) your use of the Website or its services; (b) your stored deal details; (c) your violation of these Terms; or (d) your violation of any rights of another party.
  4. Limitation of Liability
    1. Plumdeals.net will not be liable for any damages arising out of or in connection with your use of the Website. This includes, but is not limited to, direct, indirect, incidental, consequential, and punitive damages.
    2.  Plumdeals.net shall not be held responsible for any misrepresentation or lack of authority by users claiming to act as brokers or agents. Users are solely responsible for verifying the authority of any party they interact with on the Website.

To the maximum extent permitted by applicable law, Plumdeals.net shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the deal storage services, the notification system, or the software as a service platform, even if Plumdeals.net has been advised of the possibility of such damages. Our total liability to you for any claim arising out of or relating to these Terms or your use of the Website shall not exceed the amount you paid (if any) for access to the software as a service platform in the twelve (12) months preceding the event giving rise to the claim.
    4. To the maximum extent permitted by applicable law, Western Star Group, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages (including, without limitation, damages for loss of profits, data, use, goodwill, or other intangible losses) arising out of or relating to your access to or use of, or inability to access or use, the Website or its services, including but not limited to the deal storage services, the notification system, or the software as a service platform, whether based on warranty, contract, tort (including negligence), statute, or any other legal theory, and whether or not Western Star Group, LLC has been informed of the possibility of such damage. 
    5. In no event shall the total aggregate liability of Western Star Group, LLC to you for all claims arising out of or relating to these Terms or your use of the Website exceed the total amount of subscription fees paid by you to Western Star Group, LLC for the software as a service platform in the twelve (12) months immediately preceding the event giving rise to the liability, or one hundred U.S. dollars ($100.00), whichever is greater, if no subscription fees have been paid. The limitations of damages set forth above are fundamental elements of the basis of the bargain between you and Western Star Group, LLC.
  5. Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms, the Website, or the services provided by Western Star Group, LLC shall be resolved exclusively through binding arbitration administered by the American Arbitration Association (“AAA”) in accordance with its Commercial Arbitration Rules. The arbitration shall take place in Menifee, California, United States. The language of the arbitration shall be English. The decision of the arbitrator shall be final and binding on the parties and may be entered as a judgment in any court of competent jurisdiction. Each party shall bear its own attorneys’ fees and costs in connection with the arbitration, and the parties shall share equally the fees and expenses of the arbitrator. By agreeing to these Terms, you are waiving your right to litigate any dispute in court before a judge or jury. This arbitration provision shall survive the termination of these Terms.
